These Terms of Use ("Terms") are an agreement between you and Miguel Bueno, the independent developer who publishes FOLDOUT ("FOLDOUT", "we", "us"). They cover the FOLDOUT app, its online services and this website (together, the "Service"). By downloading, installing or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
You must be at least 13 years old to create an account or use online features, and if you are under the age of majority where you live, a parent or guardian must agree to these Terms on your behalf. Playing on one phone without an account has no age requirement beyond the App Store's rating. By using the Service you confirm you meet these requirements.
Online play uses your Apple Account (Sign in with Apple) and Apple's Game Center; you can also continue as a guest, in which case an anonymous account is created for you and your progress stays on that phone. You are responsible for everything that happens under your account and for keeping your device secure. You get a random username that you can change; usernames must be 3–12 letters, numbers or underscores, and we may reset any username that is offensive, impersonates someone, or infringes rights. You can delete your account at any time in Settings → Account.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use FOLDOUT on Apple devices you own or control, for your personal entertainment, in accordance with these Terms and the App Store's Usage Rules. You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, decompile or create derivative works of the Service, extract its art or sounds for use elsewhere, or use it in any way not allowed by these Terms, except to the extent the law expressly permits.
FOLDOUT offers optional in-app purchases: Ink packs (Pocket Ink, Ink Jar, Ink Barrel), the Monthly Pack, and the Fold Pass. Purchases are made through Apple's App Store, charged to your Apple Account, and subject to Apple's terms. Prices are shown in the App Store before you confirm and may change. All FOLDOUT purchases are one-time; there are no auto-renewing subscriptions. The Fold Pass covers one season (one calendar month) and the Monthly Pack covers one month; neither renews automatically.
Ink and every item bought or earned with it (maps, skins, hats, tops, color packs, emotes, pass tiers) are virtual items that exist only inside FOLDOUT. They are a limited, revocable license to use those features in the game, not property. They have no cash or real-world value, cannot be transferred between accounts or players, sold, traded, exchanged for money, or cashed out, and are consumed when spent. Ink balances and items may be adjusted, capped or removed if they were obtained through a bug, exploit, chargeback or breach of these Terms.
Purchased Ink is added to your balance immediately after Apple confirms the purchase. The Fold Pass and Monthly Pack can be restored on another device via Settings → Restore Purchases. Your Ink balance and items are saved to your account when you're signed in with Apple; guest progress lives only on the device and is lost if the app is deleted.
Because Apple processes every purchase, refund requests are handled by Apple under the App Store's terms at reportaproblem.apple.com. We can't issue refunds directly. To the extent the law allows, purchases are final once delivered and Ink that has been spent is not refundable. Nothing in this section limits rights you have under the consumer protection law of your country.
We may change the price, availability, content or rewards of Ink packs, the shop, the Fold Pass, daily rewards and other virtual items, and may retire items or seasons, at any time. Unclaimed Fold Pass rewards expire when the season ends.
You agree not to: cheat, exploit bugs, use bots, scripts, modified clients or automation; tamper with matches, ranks or the cloud save; access other players' accounts or data; harass, threaten or abuse other players, including through usernames, character looks or emote spam; impersonate anyone; use the Service for anything unlawful; or interfere with the Service or its servers. We may investigate suspected violations, remove content, reset usernames, adjust Ink or stats, and suspend or close accounts.
The only content you create in FOLDOUT is your username and the outfits of your characters. You keep any rights you have in them and grant us a worldwide, royalty-free license to store, display and transmit them to other players (for example on the leaderboard, in friends lists, on your profile, and so other players can copy your look) for as long as your account exists. You are responsible for that content and it must not infringe anyone's rights or break section 5.
FOLDOUT, its name, logo, characters, maps, art, sounds, music, emotes, code and design are owned by us or our licensors and protected by copyright, trademark and other laws. These Terms don't give you any ownership of them. Apple, the Apple logo, App Store, Game Center and Sign in with Apple are trademarks of Apple Inc. FOLDOUT is not affiliated with, endorsed or sponsored by Apple Inc.
Online features depend on third-party services (Apple Game Center, Google Firebase) and on your internet connection. We may change, suspend or discontinue all or part of the Service at any time, including online play, seasons and virtual items, with or without notice. We are not liable for any unavailability, downtime, or loss of progress, Ink or items, though we will make reasonable efforts to preserve saved progress.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Some jurisdictions don't allow these exclusions, so some may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, VIRTUAL ITEMS, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND (B) FIFTY U.S. DOLLARS (US$50). Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or fraud.
You agree to defend, indemnify and hold us harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms or the law.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service. On termination your license ends and you lose access to your account, Ink and virtual items; no refund is due except where the law requires it. Sections 4.2, 6, 7 and 9–15 survive termination.
These Terms are between you and us, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support for it. In the event the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, or consumer protection claims. Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms (for example your carrier's) when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules, except where the mandatory consumer law of your country of residence provides otherwise. Before filing any claim, you agree to contact us and give us 30 days to try to resolve it informally. Any dispute that isn't resolved will be brought in the state or federal courts located in California, and you consent to their jurisdiction, unless your local law gives you the right to sue where you live. Either party may bring individual claims in small-claims court.
We may update these Terms from time to time. We will post the new version here with a new effective date and, for material changes, say so in the app. Continued use after the effective date means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
